Welcome to Here*.
Here* is a website at itshere.app where you can save places, build lists, and see what people you trust are into. These terms cover how you can use it.
These terms are an agreement between you and Juliette Wang, based in Alameda, California ("here*", "we", "us", "our"). The website and everything we offer through it are the "Services." Using the Services means you agree to these terms. They include our privacy policy, which explains how we handle your information.

Here* is a preview
This matters more than anything else on this page, so it's first.
Here* is an early preview. We're sharing it with a small group of people to find out what works. That means:
- Things will break. Features may not work, may work badly, or may disappear without warning.
- Your data may not survive. We may reset, migrate, or delete accounts, lists, and saved places as we rebuild things. Keep your own copy of anything you'd be upset to lose. This includes anything you've imported from another service.
- Access can be withdrawn. here* is in soft launch with a small group of early users. We may end the preview, or your access to it, at any time and for any reason.
- Nothing here is finished. Don't rely on the Services for anything that matters.
We'll try to give you notice before anything drastic. we can't promise it.
Here is free during the preview.* If we introduce paid features later, we'll update these terms and tell you before you're ever charged.
Feedback
We're asking for feedback, and we want it.
If you send us ideas, suggestions, bug reports, or comments — through a form, an email, a call, or the Services themselves — we can use them freely, for any purpose, without owing you payment, credit, or confidentiality.
So please don't send us anything you consider secret or want to keep ownership of.
Who can use here*
You must be at least 18 to use the Services.
We don't knowingly collect information from anyone under 18. If we learn that we have, we'll delete it.
Your account
Give us accurate information when you sign up, and keep it current. You're responsible for what happens under your account, so don't share your login.
Don't use a username you don't have the right to use, or one meant to impersonate someone else.
If you sign in through Google or another third-party account, you're letting us access certain information from that account — you control how much through that provider's settings.

What here* is — and isn't
Recommendations aren't endorsements. When a place appears in your feed or on someone's list, that's a person's opinion. It isn't a promise from us that the place is good, safe, open, accurately described, or still in business.
Place information may be wrong. Addresses, hours, prices, and photos come from third-party providers and from other users. We don't verify any of it.
What you do offline is your call. If you go somewhere you found through the Services, that's your decision and your risk. We're not part of anything that happens between you and a business, or between you and another user.
We don't handle bookings or payments. If we link out to something that does, your relationship is with them.
Your content
Anything you post, save, write, or share through the Services — your lists, saves, notes, photos, profile — is your content.
You own it. You're also responsible for it, including having the right to post it in the first place.
Don't post anything that:
- Infringes someone's copyright, trademark, privacy, or publicity rights
- Is sexually explicit
- Is hateful, harassing, defamatory, or discriminatory
- Exploits or endangers minors
- Depicts unlawful acts, extreme violence, or animal cruelty
- Promotes scams or fraud
- Shares someone else's personal information without their consent
- Impersonates a person, place, or business
- Harasses someone who has blocked you, or is an attempt to get around a block
- Is a paid or incentivised recommendation you haven't disclosed
- Breaks any law
We can remove content or end access for any of the above.
The permission you give us
To show your content in the Services and to the people you've shared it with, we need your permission to use it.
You grant here* a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (for formatting and display), and distribute your content — only for the purpose of running and improving the Services.
Lists are public by default, so unless you change a list to private, you're also granting other people permission to view and interact with it. Anyone with the link can open a public list or profile, whether or not they have an account — and public lists and profiles can be indexed by search engines.
This ends when you delete your content or your account, except that:
- Copies may persist in backups for a limited period
- Anonymised or aggregated data that no longer identifies you may be kept — for example, how many people in total saved a place
If we ever want to use your content in marketing outside the Services, we'll ask you first.
What you can't do here
- Crawl, scrape, or spider any part of the Services
- Copy or store a significant portion of the content
- Reverse engineer the Services or try to get at our code
- Run bots or automated access, or put unreasonable load on our systems
- Try to access another user's account, or get around any security measure
- Use the Services commercially without our written permission
- Use content from the Services to build a competing product
Maps and place data
The place information on here* — names, addresses, and the maps themselves — comes from Google Maps.
That means when you use those parts of here*, you're using Google Maps too. Google's terms of service apply to you, and Google's privacy policy explains what Google does with information from that use.
We don't control Google's place data and we don't verify it. As above: addresses, hours, and details may be wrong or out of date.
Our stuff
The here* name, logo, design, and everything we've built are ours. These terms don't give you the right to use them.
We're giving you a limited, personal, revocable permission to use the Services for your own non-commercial use, as long as you follow these terms.
Ending things
You can leave any time. Delete your account in your settings. Your profile and lists disappear from here* immediately. We hold the account for 14 days in case you change your mind — log back in during that window and it all comes back. After that it's permanent.
We can end or suspend your access if you break these terms, if the law requires it, or if your account creates risk for other people or for us. We can also end the preview entirely.
Once those 14 days are up, your lists and saves are gone for good, and your lists come out of other people's saves too. We can't control search engines, though — if your lists were public, copies may sit in Google's index for a while after we've deleted ours. Our privacy policy explains what happens to your information afterwards.
The sections on permissions, disclaimers, limitation of liability, indemnity, and disputes continue to apply after your account ends.
Copyright complaints
If you believe something on here* infringes your copyright, send a notice to our designated agent with:
- Your signature (physical or electronic)
- What work you say is infringed
- What material you want removed, with enough detail for us to find it
- Your contact details
- A statement that you believe in good faith the use isn't authorised
- A statement, under penalty of perjury, that your notice is accurate and you're authorised to act for the copyright owner
We'll remove material we believe in good faith is infringing, and we'll end access for repeat infringers. If we remove your content and you think we got it wrong, send a counter-notice to the same address.

Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT YOUR DATA WILL BE PRESERVED, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY CONTENT, RECOMMENDATION, OR PLACE INFORMATION IS ACCURATE, COMPLETE, OR CURRENT.
BECAUSE THE SERVICES ARE AN EARLY PREVIEW PROVIDED FREE OF CHARGE, THESE DISCLAIMERS APPLY WITH PARTICULAR FORCE.
NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED, INCLUDING FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HERE* AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100).
SOME JURISDICTIONS DON'T ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
Indemnity
You agree to cover our reasonable costs, including legal fees, for any claim arising from your use of the Services, your content, or your breach of these terms.
Disputes
Let's talk first. If something goes wrong, email team@itshere.app and give us 30 days to sort it out. Most things end there.
Governing law. These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules.
Arbitration. If we can't resolve it informally, you and here* agree that any dispute will be settled by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Alameda County, California, or by video or phone if you prefer. An arbitrator, not a judge or jury, decides the outcome.
Class action waiver. Claims must be brought individually. Neither you nor here* can bring a claim as a class action, or join claims with anyone else's. IF THIS WAIVER IS FOUND UNENFORCEABLE, THE WHOLE ARBITRATION SECTION DOES NOT APPLY AND DISPUTES GO TO COURT.
Small claims. Either of us can still bring a qualifying claim in small claims court instead.
Injunctions. Either of us can still ask a court for an injunction to stop misuse of intellectual property.
You can opt out. You have 30 days from first accepting these terms to opt out of arbitration and the class waiver. Email team@itshere.app with your name, the email on your account, and a clear statement that you're opting out. Opting out costs you nothing and doesn't affect your access.
If you opt out, or if arbitration doesn't apply, any dispute goes to the state or federal courts in Alameda County, California, and we both consent to that venue.
Outside the US. If you use the Services from outside the United States, you're doing so on your own initiative and you're responsible for complying with your local laws. Nothing here takes away rights your local consumer law gives you that can't be waived.
General
Changes to these terms. We may update these terms. If we make a material change, we'll tell you in the app or by email before it takes effect. Continuing to use the Services after that means you accept the update.
Assignment. You can't transfer these terms to anyone else. We can, in connection with a merger, acquisition, or sale of assets.
Severability. If part of these terms is unenforceable, the rest still applies.
No waiver. If we don't enforce something immediately, we haven't given up the right to enforce it later.
Entire agreement. These terms and our privacy policy are the whole agreement between us.
No partnership. Using the Services doesn't make you our employee, agent, or partner.
